"Create a Trip on TravelMuse, Win Your Perfect Moment in Hawaii" Sweepstakes Official Rules

OFFICIAL RULES - NO PURCHASE NECESSARY. PURCHASE DOES NOT INCREASE YOUR CHANCES OF WINNING. VOID WHEREVER PROHIBITED. YOU HAVE NOT YET WON.

No Purchase Necessary To Enter or Win. Participation constitutes entrant’s full and unconditional agreement to and acceptance of these Official Rules. The “Create a Trip on TravelMuse, Win Your Perfect Moment in Hawaii“ Sweepstakes ("Sweepstakes") will begin at 12:00am Eastern Standard Time ("EST") on May 6, 2010 and end at 11:59 pm EST on July 16, 2010 ("Sweepstakes Period"). Sweepstakes is sponsored by TravelMuse, Inc., 4410 El Camino Real, Suite 102, Los Altos, California 94022 (the "Sponsor"), who is solely responsible for all aspects of this Sweepstakes.

Two Ways to Enter:
1) Qualified participants may enter the Sweepstakes by visiting www.travelmuse.com (“Website“) and following the online instructions to register and create a Trip with a minimum of five (5) saved items (“Qualifying Trip“). All registrants that create a Trip with a minimum of five (5) saved items are automatically entered into the Sweepstakes. All on-line entries must be received on or before 11:59pm EST on July 16, 2010.

Bonus Entries: Registered Entrants who have created a Trip with a minimum of five (5) saved items can earn bonus entries via the methods described in this paragraph:

a) Create additional Qualifying Trips and receive one (1) additional entry per Qualifying Trip (maximum ten (10) entries).

b) Add the TravelMuse Bookmarker and save at least one page from a website other than TravelMuse.com and receive three (3) entries.

c) E-mail friends to join a Trip created on TravelMuse and receive three (3) entries per friend for each valid registration.

d) Add the TravelMuse Trip widget and receive five (5) entries.

e) Invite friends to register and receive one (1) additional entry for every Qualifying Trip they create.

Maximum of forty four (44) bonus entries total per person regardless of method of receiving those entries.

2.) You may also enter by mailing a hand-printed entry with your name, address, day and night telephone numbers and confirmation that you are at least 18 years of age, on a 3“x 5“ card and mailing it in a standard business-size #10 envelope to: “Create a Trip on TravelMuse, Win Your Perfect Moment in Hawaii“ Sweepstakes, TravelMuse, Inc., 4410 El Camino Real, Los Altos, CA 94022. All mail-in entries must be postmarked on or before July 14, 2010 and received by July 21, 2010.

All online entries must be manually keystroked and manually entered by the individual entrant. Entries generated by a script, macro or other automated means will be disqualified. No photocopied or mechanically reproduced entries accepted. You may submit one (1) entry per person, household and e-mail address. The name of the person submitting the email address upon a Sweepstakes entry must be (a) the name of the person who used such email address to register on the Website, and (b) the name of the authorized account holder of such email address, otherwise, the entry may be deemed void. In the event of a dispute regarding who submitted a particular on-line entry, the entry will be deemed submitted by the authorized account holder of the e-mail account as of the time of the entry, and the potential prizewinner may be required to provide identification sufficient to show that he/she is the authorized account holder of such email address. "Authorized account holder" is defined as the natural person who is assigned to an e-mail address by an Internet access provider, on-line service provider or other organization (e.g., business, educational, institution, etc.) that is responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address. Proof of mailing does not constitute proof of delivery or entry. Incomplete, illegible or corrupted entries are void and will not be accepted. Sweepstakes Entities are not responsible for illegible, damaged, lost, late, misdirected, incomplete or postage due mail or entries. Sweepstakes Entities reserve the right to disqualify any person or address suspected of submitting multiple or fraudulent entries or of tampering with the entry process. All entries become the property of Sponsor and will not be returned.

Eligibility: Sweepstakes open to all natural persons who are legal residents of and physically located in the United States or the District of Columbia (excluding Rhode Island, Puerto Rico, Guam, U.S. Virgin Islands, and all other U.S. and foreign territories and possessions, and excluding where otherwise prohibited by law, rule or regulation) that are 18 years of age or older during the Sweepstakes Period. Only one entry allowed per person. Employees, officers and directors of Sponsor and its affiliated companies, subsidiaries, agents, advertising and promotion agencies, Hawaii Visitors and Convention Bureau (collectively including Sponsor, “Sweepstakes Entities“), their immediate family members (parents, children, siblings, spouses) and persons living in the same household (whether related or not) are not eligible to participate in the Sweepstakes. Void where prohibited. All federal, state and local laws and regulations apply.

Prizes: The One (1) Grand Prize winner will receive a 6-day/5-night trip for two (2) to Honolulu, Hawaii. Trip includes: A) Round-trip coach air transportation from any city in the United States to Oahu and ground transportation, courtesy of the Hawaii Visitors and Convention Bureau; B) ocean front hotel accommodations (double occupancy) at the Hilton Hawaiian Village® Beach Resort & Spa Waikiki, including complimentary tickets for two to its Waikiki Starlight Luau; C) Ali’i Luau Package for two at Polynesian Cultural Center, including general admission, Ali’i Luau and tickets to “Ha: Breath of Life“; D) Admission and Battle Stations Tour for two at Battleship Missouri Memorial, including general admission and guided tour; E) Dolphin Swim Adventure program for two at Sea Life Park Hawaii; and F) Atlantis Submarines sub tour off Waikiki for two.

The Approximate Retail Value (“ARV“) is $4,750. Actual value may vary based upon point of departure. The winners are responsible for charges, costs and expenses not expressly set forth in these rules including but not limited to all meals, taxes, gratuities, telephone, room service, other hotel services, and travel expenses between the winner’s point of departure.

Prize Restrictions: No alternative prize, cash equivalent, or other substitution is permitted, except by Sponsor in the event of prize unavailability. Prizes are nontransferable. All travel arrangements are to be administered by Sponsors or their designee(s). Winner must give a minimum of sixty (60) days advance notice of desired departure date and all travel must be completed by August 6, 2011. Hotel prize is based on room availability; blackout dates apply. Other restrictions may apply. No changes will be made to travel details once any portion of travel arrangements has been made. Prize conditions may be added or modified by Sponsors. All federal, state and/or local taxes, and other expenses associated with the acceptance and use of any prize are the sole responsibility of the winner. THE PRIZE IS PROVIDED “AS IS“, AND SPONSOR DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED WITH RESPECT THERETO, INCLUDING WITHOUT LIMITATION THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NONINFRINGEMENT.

Sponsor reserves the right to verify all information submitted by Grand Prize winner. No transfer, refund or substitution of Grand Prizes are permitted, except that the Sponsor and Sweepstakes Entities retain the right to substitute prizes of equal or greater retail value for any reason. Odds of winning will depend on the total number of eligible entries received.

The sponsor of this promotion is TravelMuse, which is solely responsible for all aspects of the promotion. By participating in this promotion, all participants and prize winners agree that Hilton Worldwide, their partnerships, subsidiaries and affiliates and each of such entities’ respective officers, directors, agents and employees are not responsible or liable for any injury, loss, illness, litigation or damage that may occur from participation in the promotion or acceptance, possession, use or misuse of prizes. In the event that any dispute arises regarding the meaning or interpretation of these official rules, participants agree that the dispute shall be resolved by applying the laws of TravelMuse and that it shall be resolved by and within the courts of that TravelMuse. Drawing and Notification: The potential Grand Prize winner will be selected, from among all eligible entries received, in a random drawing conducted on or about July 30, 2010 by an independent judging organization, whose decisions are final and binding in all matters relating to this Sweepstakes. Grand Prize winner will be notified by e-mail or by telephone if winner does not have an e-mail address within seven (7) days after the drawing date. In order to claim prize, winner will be required to complete a W-9 Form and an affidavit or declaration of eligibility and/or liability and publicity release which must be signed and returned so that it is received within seven (7) days of date printed on notification or alternate winner will be selected at random. The prize will be mailed to the winner via Federal Express, or other home delivery service of Sponsor’s choice.

Prize Conditions: If a prize or prize notification is returned as unclaimed or undeliverable to a potential winner, if potential winner cannot be reached within three (3) calendar days from the first notification attempt, or if potential winner fails to return requisite documents within the specified time period, or if a potential winner has not complied with these Official Rules or is otherwise ineligible in any way, then such person shall be disqualified and, at Sponsor’s sole discretion, an alternate winner may be selected. Accepting and/or using the Grand Prizes constitutes the Grand Prize winner’s permission (except where prohibited) for the Sponsor to use said winner’s name, photograph, likeness, statements, biographical information, voice and address (city and state), in all forms of media, in perpetuity, without notice or further compensation. A Sweepstakes entrant can only win one prize; once an entrant has been selected for a prize, their name will be removed from future prize drawings. Sponsor will not replace a lost or stolen prize.

Terms & Conditions: This Sweepstakes is subject to all applicable federal, state, and local laws. By participating, entrants agree to be bound by these Official Rules and the decisions of the Sweepstakes Administrator, and waive any right to claim ambiguity in the Sweepstakes or these Official Rules. The Grand Prize winner and entrants also agree to release, discharge, indemnify and hold harmless the Sweepstakes Entities and the Sweepstakes Entities’ agents and representatives, affiliates, subsidiaries, advertising, promotion and fulfillment agencies, and legal advisors from and against any claims, damages or liability due to any injuries, damages or losses to any person (including death) or property of any kind resulting in whole or in any part, directly or indirectly, from acceptance, possession, use or misuse of Grand Prizes offered, or participation in this Sweepstakes.

Internet Limitations of Liability: If for any reason this Sweepstakes is not capable of running as planned due to infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the control of the Sponsor which corrupt or affect the administration, security, fairness, integrity or proper conduct of this Sweepstakes (a “Sweepstakes Interruption“), the Sponsor reserves the right at its sole discretion, to cancel, terminate, modify or suspend the Sweepstakes in whole or in part, at any time, without notice and award the Grand Prizes using all non-suspect eligible entries received as of, or after (if applicable) this Sweepstakes Interruption in any manner that is fair and equitable. Sweepstakes Entities and the Sweepstakes Entities’ agents and representatives, affiliates, subsidiaries, advertising, promotion and fulfillment agencies, and legal advisors are not responsible or liable for, and shall be released and held harmless for any (a) error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of, entries; (b) any printing or typographical errors in any materials associated with the Sweepstakes; (c) problems or technical malfunction of any telephone network or telephone lines, computer on-line systems, servers, or providers, computer equipment, software, failure of any e-mail or entry to be received by Sponsor on account of technical problems, human error or traffic congestion on the Internet or at any website, (d) to the extend not included in (a) through (c), any Sweepstakes Interruption, or (e) any combination of (a) through (d), in each case including any injury or damage to participant’s or any other person’s computer relating to or resulting from participation in this Sweepstakes or downloading any materials in this Sweepstakes.

By entering this Sweepstakes on-line or by mail, you agree to be bound by these Official Rules. The Official Rules will be posted at the Sweepstakes page on the Website throughout the Sweepstakes. Sponsor reserves the right at its discretion to disqualify any individual it finds to be tampering with the entry process, either on-line or by mail, or the operation of the website; to be acting in violation of the Official Rules; or to be acting in a disruptive manner, or with intent to annoy, abuse, threaten or harass any other person. CAUTION: ANY ATTEMPT TO DELIBERATELY DAMAGE ANY WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE SWEEPSTAKES IS A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, THE SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES OR OTHER REMEDIES FROM ANY SUCH PERSON (S) RESPONSIBLE FOR THE ATTEMPT TO THE FULLEST EXTENT PERMITTED BY LAW.
